1. Acceptance of Terms

By accessing or using the Galaxia Creators platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

2. Regulatory Compliance

2.1 EU MiCA Compliance

This Platform operates in compliance with the European Union's Markets in Crypto-Assets Regulation (MiCA). Users acknowledge that crypto-assets are subject to regulatory requirements and may be restricted in certain jurisdictions.

2.2 US Regulatory Framework

Users in the United States acknowledge that this Platform may be subject to federal and state regulations including, but not limited to, FinCEN requirements, state money transmitter licenses, and SEC securities regulations. The Platform reserves the right to restrict access based on regulatory requirements.

2.3 UK FCA Compliance

Users in the United Kingdom acknowledge compliance with Financial Conduct Authority (FCA) regulations regarding cryptoasset activities and financial promotions.

3. Risk Warnings

IMPORTANT RISK WARNING

  • Crypto-assets are highly volatile and you may lose all of your invested capital
  • Crypto-assets are not protected by deposit insurance schemes
  • Regulatory frameworks are evolving and may impact the Platform's operations
  • Technology risks including smart contract vulnerabilities, hacking, and loss of private keys
  • Market liquidity risks may prevent you from selling assets when desired
  • No guarantee of returns or asset value preservation

4. KYC/AML Requirements

You agree to provide accurate and complete information for Know Your Customer (KYC) and Anti-Money Laundering (AML) verification. The Platform may require:

  • Government-issued identification
  • Proof of address
  • Source of funds documentation
  • Beneficial ownership information (for entities)

The Platform reserves the right to refuse service, suspend accounts, or report suspicious activity to relevant authorities as required by law.

5. Sanctions Compliance

You represent and warrant that you are not, and are not acting on behalf of, any person or entity:

  • Subject to sanctions administered by OFAC, UN, EU, or other relevant authorities
  • Located in a jurisdiction where crypto-asset services are prohibited
  • Engaged in money laundering, terrorist financing, or other illegal activities

6. Transaction Monitoring

The Platform monitors all transactions for compliance purposes including:

  • Suspicious activity detection
  • Travel Rule compliance (for transactions exceeding regulatory thresholds)
  • Sanctions screening
  • Transaction velocity and pattern analysis

Transactions may be delayed, blocked, or reported to authorities as required by law.

7. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, and software, is the property of Galaxia Creators or its licensors and is protected by copyright and other intellectual property laws.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. The Platform shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

9. Dispute Resolution

Disputes shall be resolved through:

  1. Direct communication with our support team
  2. Formal complaint submission (response within 15 business days per MiCA requirements)
  3. Alternative Dispute Resolution (ADR) mechanisms
  4. Arbitration or court proceedings as applicable by jurisdiction

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified to users, and continued use of the Platform constitutes acceptance of modified Terms.
